Force Majeure shall include contingencies caused by neither of the parties and unforeseen occurrences/circumstances such as war, fire, tempest, floods, earthquake, civil unrest, strike, acts of the Government, or any other event that can be attributable to an act of God and in such an event, none of the parties shall be deemed to have committed any default in the performance of its obligations under this Terms of Use of any other happisigns Policies. In such case, if happisigns cannot deliver the purchased product, except for a refund of payments already received towards the purchased products, happisigns will not be liable for any damage caused to the Buyer.
Terms of Use shall be governed by and interpreted and construed in accordance with the laws of India. Subject to the Dispute Resolution provisions stated hereinbelow, the Courts at Mumbai shall have exclusive jurisdiction.
Any dispute arising out of the use of this Website shall be reported to the ‘Grievance Department’ of happisigns at [insert email id]. In the event that the Grievance Department is unable to resolve the dispute within 30 days, the dispute shall be resolved through binding arbitration. The arbitration shall be conducted by a sole arbitrator to be appointed by happisigns. The arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996 as amended from time to time. The place of arbitration shall be Mumbai, and the proceedings of arbitration shall be conducted in the English language.
